Terms of Use

This is an English translation for convenience; in case of any discrepancy, the Turkish version prevails.

1. Parties and subject

These terms govern the use of the platform offered on serbestis.com and its subdomains ("Platform") between E-veri Bilişim Turizm San. ve Tic. Ltd. Şti. ("Serbest İş") and the person who becomes a member ("Member"). By becoming a member you confirm that you have read and accepted these terms.

2. Role of the Platform

  • Serbest İş is a listing and communication environment that connects people who want work done ("Clients") with freelance experts ("Experts"). Under Turkish Law No. 6563 it is an intermediary service provider and is not a party to the working relationship between a Client and an Expert.
  • The scope, price, duration, delivery, intellectual property rights and tax obligations of the work are agreed between the Client and the Expert and are their responsibility.
  • There is no commission. Posting projects, receiving and sending proposals are free.

3. Payments

  • Payments are made by stage, directly from the Client to the Expert. Serbest İş does not receive payments, does not hold money, does not provide escrow and does not act as a payment intermediary.
  • The "I paid" and "I received the payment" records on the Platform are only the parties' statements; they are not a guarantee by Serbest İş that a payment was made.
  • We recommend splitting the work into small stages and paying each stage after delivery and approval.

4. Membership

  • You must be at least 18 years old and have legal capacity to become a member. Members confirm that the information they provide (name, e-mail, mobile phone) is accurate and up to date.
  • Members are responsible for the security of their accounts; do not share your password.
  • One person may not open multiple accounts or open an account on behalf of someone else.

5. Experts, AI agents and responsibility

  • Experts may add the AI agents and tools they use to their profiles. This information is the Expert's own statement and is not verified by Serbest İş.
  • Even when agents are used, it is the Expert who accepts, reviews and delivers the work, and the Expert is responsible for its accuracy, quality and legality.
  • The Expert must state honestly in the proposal which tasks will be done with agents and which by hand, and must follow the Client's data / AI preference (allowed / only models running on their own server / no AI). Acting against this preference is a breach of these terms.
  • The Expert uses information and documents received from the Client only for that job and keeps them confidential.

6. Sharing contact details

Phone numbers and e-mail addresses are not shown publicly. When a Client accepts a proposal, the contact details of the Client and the selected Expert are shown only to each other. Members may use them only for that job and not for advertising, spam or any other purpose.

7. Quality control and consulting

A Client may ask Serbest İş to review the delivery of a stage or of the whole project. The scope and fee of this optional service are agreed separately after the request; no fee arises without such an agreement.

8. Prohibited use

  • Publishing unlawful, misleading, discriminatory, obscene or harmful content, or content that infringes others' rights.
  • Creating fake projects, proposals or reviews; creating accounts or content with automated tools (bots).
  • Using the Platform to collect other members' contact details or to send advertising or spam.
  • Attempting to compromise the security of the Platform.

9. Reviews

Reviews can only be written after a stage has been paid (completed). Reviews must be honest, relevant to the work and respectful; otherwise they may be removed.

10. Suspension and closure

In case of a breach of these terms or the law, Serbest İş may remove the relevant content, suspend or close the account. Members may ask for their account to be closed at any time by writing to info@serbestis.com.

11. Intellectual property

The design, software and brand of the Platform belong to Serbest İş. Rights to content uploaded by members belong to the members, who grant the licence needed to display it on the Platform. Rights to work products are agreed between the Client and the Expert.

12. Limitation of liability

As an intermediary service provider, Serbest İş is not responsible for the performance of work between members, for payments, for the quality of delivered work or for the accuracy of members' statements, and to the extent permitted by law does not guarantee that the Platform will operate without interruption or error.

13. Personal data

Your personal data is processed in accordance with the Privacy Notice (KVKK) and the Privacy Policy.

14. Changes and governing law

Serbest İş may update these terms; significant changes are announced on the Platform. These terms are governed by the laws of the Republic of Türkiye; the courts and enforcement offices of İstanbul (Anadolu) have jurisdiction. The rights of members acting as consumers to apply to consumer arbitration committees and consumer courts are reserved.
